Every criminal offence requires proof beyond a reasonable doubt of not only an actus reus element, but also of some form of mens rea or fault element. One discerns the nature of the mens rea by reference to the language in the relevant section of the Code, the common law, actual practice, and most recently, Charter judgments. This part of the materials raises the following questions: How have the judges used the Charter to formulate the mens rea? What is the real significance and impact of the mens rea requirement upon accused persons, upon women who have survived male violence, and upon our social understandings of what is a criminal or blameworthy state of mind? Does the legal formulation of the mens rea permit successful prosecution of individuals who act as a group, as in the case of gang rape or through a corporate structure?
One of the main preoccupations of the judges has been to determine whether a given mens rea is tested subjectively, by reference to the accused's evidence (if believed), or objectively, by reference to what a reasonable person would have thought or intended by those actions. This preoccupation has been reinforced and given constitutional significance through a series of judicial decisions that have interpreted s.7 of the Charter as having implications for the justness and therefore legality of the mens rea requirement for given offences.

In fact the issues were about his covert conduct and no violence was immanent at all, except for the threat of violence from the ashram to prevent exposure of their corruption and underhandedness. There was intense discussion among the students as to Shyam Charan Srivastava's integrity, his honesty, the validity of claims and certainly of his capacity as guide and guru. To liberate his followers from misunderstanding, misinformation, hypocrisy and mendacity is, of course, in the service of humanity. These efforts by the majority of students were not to destroy his following but to uplift them, for them to be enabled and re-enchanted. Blaiming the egos is only his way of damning real knowledge and real freedom from ignorance. His hidden agenda catered extensively to his own greed and lust—that being connected to his self image and position of guru, and his urgent need to secure a place for himself, to have power in the relative world. In other words his greed and lust were not of the ordinary kind but were manifesting as the urge to kingdom, the realization of the Ras Leela, and of the ancient dream of Vrindavana according to his own selfish understanding, and that of millions of backward thinking Bharatiyon (Indians).
He has abhimaana —the intention to injure, insidiousness, high opinion of one's self, self-conceit, pride, haughtiness conception (especially an erroneous one regarding one's self)—though he is very good at disguising it with India's hoi polloi understanding, and is really atmakaaraka an agent of his own personal self. His motivation does not come from beyond Doership but from his own (excessive) personal ambition. Without vairagya (detachment) he is not Self Realized (jeevan mukti, kevalya, moksha) and leads his followers into delusion—lack of real awareness. His teachings are fraudulent through and through because he does not know of what he speaks—the Highest Self that he never realized.
His real worry here is that the liberated students would turn around and expose him in India, thus bringing his critics out in droves, along with the police who would in turn demand that the ashram be closed, his remaining followers deported. Because so many older students had come to be very dependant on the Swami and had no resources left in their home towns, they were very afraid of being sent back, and their thoughts would also turn to violence about indictments against 'Swami Shyam' for murder, rape and pedophilia. However it is the police who arrive with arms, while the ashram reaction is to smash the heads of the students who would cause the closing with rocks. As for the comparison to Pol Pot: that is the province of the psychiatrist and I venture no explanation. Perhaps it has something to do with the huge violence in India between the Muslim and the Hindu after Independance. Or again he might be seeing the moral force of the West as if it were a dictatorship of the righteous.
Thus many students who had come from good homes in the West had, over the years, become impoverished and scarcely able to maintain themselves outside the ashram. He cozened them about violence as will be seen later in the "satsang" called The Kshatriya and the Cows, and about pedophilia in The Guru, the Snake and the Power of Discrimination.
The reason I put 'Swami Shyam' in quotes or brackets is that he was never ordained a "Swami" by any legitimate institution or group of India. He is self-styled Swami and has no real credentials.
RE: Murder of Melissa Baer in Kullu valley
The charges here could be to Shyam Charan Shrivastava, the Shyam Space Group in Kullu Valley and the Kullu Valley authority.

There is a sequence of events which over time show results from the slow redirection of SCS's student affairs. First Archana's (Sheila Wright) father (Hume Wright) committed suicide (refer to Globe Mar 3, 2001 - arguments with SCS Kullu concerning his daughter Sheila) leaving Archna and Gyanindra $300,000 each (Giibbie was cut from the will but the mother, a Shyam, gave him half of her own) . and then Sheila or Archana she returns to Kullu with Shankar (Harold Breck) as her main mate. Gyanindra leaves the group with Mukti. Then there is the tour in Kullu with SCS where he charged $10,000 to twelve students for two weeks (refer earlier description). That makes $120,000 of his own money. Subsequently he wins the Yog Shromani award in India. Now he has the money and the prestige to do whatever he wants. By 1986 Rajneesh has gone through Kullu and Manali and in fact has stayed at the Empire Hotel which is right next door to the ashram. He (SCS) has an example to follow. In 1989 he (SCS) comes to Canada and gives me a kiss and says nothing about spooks. Following this, there is the pedophilia on the little girl and the shooting of Krishna Kaant. About three years later Atmaananda (a black belt in Kempo) goes berzerk in Kullu and the almost killing of Kabir and Nootan. Aatmaananda kicked Gayatri in the stomach started the incident. Then Kabir leaves. For almost ten years SCS is getting away with it.
He (SCS) has been having sex on the students, yelling in their faces and corrupting anyone in the valley while making large amounts of money. He has money of his own. In 1998 he entraps and probably murders the girl Melissa for asking important questions and after there is Hell to pay. Soon he gets Giridhaar (who has committed a felony of dope dealing in Seattle and spent 2 years in Jail) to take Malti to Canada. Both Malti and Kabir are out of there. Both were important and straight figures at the ashram. Kabir was contentious but Malti was devoted, she was the ashram's No. 1 woman for a long time. Shankar is thought to be insane and suicidal and is threatened. He leaves and many of the Kullu-ites are at a loss for cash. He now suggests that they rely on him. Examination of the power structure in his ashram will show the changes made to insure that he will not be deprecated, reprimanded or arrested during this process.

The point is that there is much going on at the ashram and that Melissa was a student in the West of not only psychology but also was planning on a law degree. She was new to the scene and had not yet been incorporated ("her mind dissolved", "baked", "blown", "fried") and was not a drug addict or dealer. Since there was so much to cover up (see testimony in Appendix) and since Melissa was a friend of Rita (Ritambhar) she could possibly discover the many undercurrents at the ashram without going through what SCS concidered the necessary conditioning to accept his evils. Rita had been at the ashram for many years and had despite a nervous breakdown (on account of stress at the ashram in the middle eighties) returned to Kullu valley. She might have broken out of her mindset and conditioning of many years and begun to expose SCS totally.
He (SCS) hoped (according to Jocyline Cardinal - see testimony later) to overpower Melissa in the large satsang and yet that must have failed. The more he tried the more she was suspicious and hoped to liberate her friend Rita May Zelicovitz. As from the testimony below she was really abused and frightened. There is a high probability of some sort of sexual assault by SCS including trying to open mouth kiss her (inserting his tongue in her mouth - as done to others before), touching her breast, or even rape.
"After about 15 minutes, Swami Shyam made his appearance. He is a short, dark man with a wavy beard and a round, mischievous face; he wore a crystal mala with a silky lavender tassel and a fringed blue robe that made him look like an elfin magician. He greeted me with a warm handshake, pronounced me a "sweet girl with big eyes," and before I had time to get offended -- turned to the crowd and asked, "Are you thirsty? If so, we can order chai. Are you hungry? I can give you chocolates. Are you eager to know the Self, understand the Self, be the Self? If so, I can lead you in that direction." with Akhilesh as driver: underage and possibly smoking hash. Akhilesh

frightened and runs. Suresh gets in the driver's seat and returns to

scene and claims he was driving. The settlement in court for the death
is cash.

SCS : ~1972-3 tells story abut how he went up to the border and fired
across at somebody. In retrospect I thought it was Pakistan but could
be
any county border, (i.e. Jaalaun) or not even happening but cozening
somebody
else's shootings among his students..
The Akhilesh incident is sufficient reason to retain him for
questioning.

Melissa must have taken flight in the dark and had tried to escape from the ashram then ending up in the river. No names are given of either the doctor involved in the testimony or the passerby who said she had repeatedly "thrown herself into the river."
They claimed at the ashram that an "Indian man" had said she had thrown herself into the water 4 times. That is she is trying to avoid the passer by if that is what he is, by entering the water. Did she intend to get to a safe haven and if so did she take her stuff her wallet and other things with her? Were the passport and wallet returned? Since she must have been frightened by the confinement and by having been given drugs didn't she then suspect that any casual observer was there in the service of SCS and was to be avoided. So even if that were the case that she had thrown herself into the water and had not been strangled first there is still reason to believe that she had
"arrangement under which money or anything of value passes or is intended to pass from one person to another, or is promised by one person to another, as consideration for that other's causing or assisting in causing the death of anyone or counseling another person to do any act causing or assisting in causing that death."
Anybody in the Valley would know how rich SCS is and how much he would donate if they have a good story for him. See accusations by Lee Hunter (Pramod) and corruption of officials.
There is much to know about Melissa before we make a judgment that she had committed suicide. Did she ever attempt suicide before? Did she think she was a good swimmer and might have made it out of Kullu by water? But whatever way you look at it SCS has criminal liability as he was a) a pedophile concerning {parents of victim} and their daughter b) boasting of his accomplishments of murder (as per satsang below) and c) really needing to cover up his evils. Thus it could be Murder One, Two but nothing less. The motive for murder is to cover up the evils of the ashram and make sure that no one can hear the gross facts about Swami Shyam. Hence the burning of the diary of Melissa Baer is the main point that inculpates the ashram and crorepati (rupee millionaire) "Swami Shyam."

What was a rich man to do except to firmly say, "No, do not touch me there and I want only some real massage." Cutting off of hands is only sanctioned in Muslim law and not Hindu and/or Western law.
"Shyam Space Dikpaal and SCS were busy erasing records when John Fife or someone came upon them and found out. They claimed at the ashram that an "Indian man" had said she had thrown herself into the water 4 times ( and therefore was trying to drown herself. The name of the Indian man was not given. Note here that SCS knew that his main man in Montreal during this period was a pathological liar and that is why he paid for him to go to Kullu and promoted him as his main video artist. Late he made a film for him with the brother of the wealthy Jewish woman Rietman, who is here implicated in his pedophilia and rape. It was Sidney Goldberg's sister Noreen that told me that Sidney was a pathological liar while we lived in the fleeting Norman Street Ashram in Ottawa. Same with the accusations about drug addicts. SCS was himself known to smoke gaanjaa or marijuana on occasion and often promoted drug dealers to his highest inside relations. -epg

There was an insider group of about 30 or 40 people who were scarcely paying fees anymore, who were kept going by fees from the ashram, and who made it their business to promote their guru and to find new and wealthier clients that would contribute so much to the ashram that they would not ever have to return to the West only to have to get regular jobs.

This is what I learned. Melissa's body was discovered in the river near Buntar. A doctor who is a shyam did the post mortem and concluded that she was not drowned, but strangled. But SS announced that Melissa committed suicide, and I cannot help but wonder if her family know any of this. Then when I just read from shaymtruth emails that people believe that Melissa was drowned, I feel compelled to share what I learned. I have no direct evidence of what transpired one way or the other. But when I learned that SS ordered all video and audio tape recordings of Melissa erased, I could not help but think that something more sinister was involved. Maybe people felt that they had to remain silent so as to avoid getting the entire community in trouble with the authorities.
Maybe. Still, I find it appalling that such a cover-up could happen, ordered by SS. It might sound cliché but isn't it true that 'Actions speak louder than Words'... And what horrible actions have taken place all in the name of 'Oneness' I feel a tremendous relief in myself to finally stop giving any credence to such 'Spiritual' nonsense such as 'only guru can understand gurus actions' Such philosophy is incredibly dangerous. It's only now that it's coming to light how this kind of philosophy allowed terrible, truly terrible things to take place. To be able to speak openly, finally, is fantastic and will start the healing that we all need and to move on to a much greater space.

Criminal harassment

Murder reduced to manslaughter
232. (1) Culpable homicide that otherwise would be murder may be reduced to manslaughter if the person who committed it did so in the heat of passion caused by sudden provocation.
What is provocation
(2) A wrongful act or an insult that is of such a nature as to be sufficient to deprive an ordinary person of the power of self-control is provocation for the purposes of this section if the accused acted on it on the sudden and before there was time for his passion to cool.
Re: the shooting of James Frosst (Krishna Kaanta)(KK) in Kullu Valley, 1988-9
"With regards to KK. I heard the story from his own lips as he is a close friend of Kevin's. He went hiking and camping in the mountains as he is known to do. This time he was alone because no one wanted to go. Anyway he was sleeping in his little tent when all of a sudden heard and felt a gun shot. Someone had shot him through the tent. He was shocked of course and knew he had to get away from this person so he darted out of the tent and kept running. He barely made it. Luckily he has long legs. He lost a lot of blood but finally made it to the hospital and survived.
His reflections on it were that he was in a mineral exploration zone unknowingly and got into someone's territory. Basically he was in the wrong place at the wrong time. I believe his story to be true."

Interpol has already gone through Kullu about 2-3 years ago. I don't think they know enough about "ShyamSpace" to put it all together. There is an item which I am currently trying to have witnessed that he (SCS or Swami Shyam) has sent money to a man in the south.
1989? "that Dinesh (Dan Chernin ) had gone to the "south" With Swami Shyam some time earlier and had handed "a brief case" full of money to someone, a "heavy-looking" dude."
Thus this could be construed as paying a hitman for services.
"I am curious as to why KK was shot. Do you know the circumstances? Joseph was very upset to learn about this, as they were close friends while he was there."
"I don't know. . . . Otherwise I heard that he had been walking in a certain neighborhood and had been fired on, "because he wasn't supposed to be there." He was a computer teckie and had set up a computer in Kullu. I think that SCS didn't want people to see his stuff if it wasn't done by his insiders. That is because he had put some really heavy twists in his writings (as I have seen in Yog Vashishta a twisty turny translation of one chapter where he subliminally craps on Vaani and Raam Dev- even though of their names only Raam is in the original). So when KK started transcribing tapes and distributing the printouts to people he got angry and sent him for a walk and he was shot. That is my theory. His wife Shirlie Frosst was treated like a serf in Montreal and was called atulaa (a tool).
Re: the death of Rebecca Carson (ParamSukh)
Becky died about the same time.
1. Then Becky Carson is swiftly sent to England despite or because of her health. She dies. Now Doug Carson is the husband but he is the Dayal - Dial. This is obvious from the fact that he works in communications for the Ontario government. He is the one who is web master and composer of ShyamSpace.com site from Kullu valley. Not only he is the one who composed the Blue Book and printed it and also was the host of the Delight meets Delight conference in Toronto. So whose tits are those toes of SCS tickling in the back room of the conference (from the egroups/shyamtruth site). Is it Becky? Did Doug know?

This story appears on the Shyam Space Web site and was issued in the year 2000 just prior to the egroups/shyamtruth site at yahoo.
The satsang here included (pro bono publico) is for the public benefit and therefore needs no permission to reproduce it as it is evidence against Swami Shyam or Shyam Charan Shrivastava of Kullu Valley. The point is that not only is SCS stating the the 200 "cows" (his devotees) are being led to the slaughter house (i.e. if he is exposed and the ashram closed) but that he is willing to shoot the four people he holds most responsible. He frankly admits that he ought to have been hanged three times already and that he has not died (he has escaped prosecution). There is possibility that the three cases represent Melissa Baer (died), Becky Carson (died), and James Frosst (shot), or the fact of the pedophilia. Note here that an old friend Atmaananda of the pedophilia victim's parents was involved in an incident in which he had aimed a lethal blow at one of the disgruntled students Kabir. It was clear that the parents were not aware of any such motivation such as would involve them in that event. But after the event the it is clear that SCS had condoned his act and had given him a warm farewell and acted pleased with him. Since that man was now condemned he would not be able to defend the father of the victim in any other way, and further any claim on the part of the parents against SCS would be discredited by their association with Atmaananda.
That specific individuals are mentioned in the same speech as possible "four persons died" and that these are to be associated with ,
One says, "I am Canadian." Canadian Indian." English." French, Québecois." Well the Canadian Indian is the Metis origin Giselle Beaupre while the Quebecois must be Jean Bouchart Dorval and likewise others. In any case it is clearly a threat to those who wish to expose SCS.
Although it cannot be admitted as testimony in
a court of law the real threat to the 200 students is returning to
Canada
to eventually be destroyed by his gang of criminal spooks. It took me
nearly
8 years to even begin to stop them, even with the advantage of being in
the body and at times I thought they might manage to kill me physically
or destroy my mind such that I would be rendered completely mentally
incompetent.
Else wise and converting the sense of it to losses for SCS one could
think
of the students as Cash Cows which is an expression that SCS knows very
well. To believe that he is really concerned for cows or for students
for
the own sake is to be taken in completely.

Swami-ji: Whenever we see a cow we will protect it; we will not kill. I’ll give you one very good example. Two hundred cows were being taken to be slaughtered. A Kshatriya on his horse was also going on this path, on his big horse, having his double-barrel gun. At that time they used to have those. So he saw the cows, and they were all lean and thin, and going to be cut. Some small, small cows also.
He called out, "Who is taking this group?"
The people taking the cows were very haughty because they make so much money.
One said, "Who are you? Go your way!"
He said, "Leave these cows." They said, "No. We have bought them."
He said, "For how much money have you bought them?"
"Very throw away prices: less than five hundred rupees—two rupees per cow—because those who sold them are so needy they don’t care whether they have life or not. So, in order to save their fodder, they just sell."
Needy persons. No country should be needy. No man should be needy. So the Kshatriya said, "Well, I’ll give you double the price at which you bought them."
They said, "No. We’ll make a hundred times more than what you are giving to me."
So he said, "I am saying I will give you double of the price! Leave them!"
They said, "No."
He was Kshatriya. He took the gun and shot — all four persons they died. And he let the cows loose. They just had their joy of mukti.
As you see with British beef. They put so many in the trucks that there was a movement in France to give them some space when they are transported.
"Give them some space," they say, but then cut them any way.
I have many stories like this because I have a television. [Laughter] And when I am not in satsang, what can you do? You don’t study. When you have television you don’t study. You watch the cricket match!
That Kshatriya chap was hanged because four persons he killed—as you sow, so shall you reap.
Nobody can share your karmas. That is karma theory. Whatever you do, you will have to deal with the results.
A patient in hospital had never been good to his relations. But on reaching the hospital he says, "Come and see me. Come and visit me." Who would ever go there? Therefore you have to be nice to each other.

But guru chaytna burns all your karmas. Why? Because there is no relation. Bondage of relation is, for each person, acting and getting the result of their action. With hellish action you’ll get hell. With heavenly action, you will get heaven. You will have to live in hell that many years or you will have to live in heaven many years. But it is due to the action that you have owned and done. Everybody does wrong actions. So how would you get the result which is right? These many years—thirty years—have been taken for everyone to become right.
Thirty years time! No guru waits for thirty years for making you right!
You see how it works. The Kshatriya was hanged for shooting the four men. He was on the gallows; the order was given and he was to leave the platform and hang and die with that hanging cord, noose. But he didn’t die.
He was hanging but he didn’t die. The people were very surprised. They said, "Well, once he is saved. But second time?"
Again they took him back, and again they dropped him.
He didn’t die.
Three times.
It was the law that if you are saved three times, they leave you. So the third time, after he was hung, he was again standing; and he was again OK. So he was let loose. Raam was Kshatriya. Kshatriya! Bodiless!

You try to understand with reason why it is. Reasoning power fails with a human being. Those who are dependent on reasoning power will meet the dead end of misery. Guru says, "There is no reason why the world is going on like this. There is no reason why the rain falls on Guru Poornima day."
Who is that who is governing the whole thing? Who is that who is governing this? Who is governing that? Who is governing all these people? It is not known. And if you try to apply your reason, you will go crazy. There is no reason. In a minute, everything changes. What is the reasoning now? How does it change? We are living in day-to-day life. We are observing, and all this is happening. So the judge asked the Kshatriya, "What happened to you? How did you get saved? Everyone in this jail who was hanged before died."
He told him, "Under my feet, whenever you released me, there were cow horns on which my legs were supported."
Good karma! Even though he killed four persons!
God knows how many karmas you have done, but they are all burnt. [Applause] Never repent. What ever has been in the past, it’s all burnt. Therefore you remain mukt and free. This year, on Guru Poornima 2000, wherever you are, don’t become victim of the words and of the information of the people. Don’t believe in them.
A man is a man because he is either into gain or into avoiding loss. What consciousness is this? It’s called raag (attraction) and dwesh (aversion). What is raag and dwesh? It is ‘I’, ‘mine’. What is ‘mine’? That which is found to be here in this body. I am here, you are there. According to my might and power, I am here, you are there.
One wave says, "I am belonging to Atlantic."
Another wave in the same ocean says, "I am Arab Sea."
And both are in the great ocean.
One says, "I am Canadian."
One says "I am Canadian Indian."
One says, "I am English."
One says, "I am French, Québecois."
So everywhere there is duality. I am talking about worldly things, and you know it. And having known the changing minds of people, and the changing nature of the world, you should not relinquish your unchanging, your being. Guru is unchanging. Everybody wants to understand what is happening: what great-grandpa did, what the previous governments did, what the world organizers did, what happened in Fiji where hostages were released yesterday. One day a man was Prime Minister, the next day a hostage. What happened? You cannot understand. Therefore what is essential? To give up this type of understanding which means rise above it. If waves are bothering, why do you surf-ride? Leave the board! That’s all. And that’s my stage. I tell you this on Guru Poornima: when something happens, only God knows what happens; it will not happen in a way which any person has thought.
There is a shloka (spiritual writing) which says:
"The devotee is the one who has attained sam [evenness]"
In heat and cold, he remains sam. With friend and its opposite he remains sam. With things and forms, with people coming and going, he remains sam. Who will remain sam? The one who is tuned in to guru. Guru’s vision is sam. In the vision there is no such thing as blue eyes or black eyes. Vision has no colour; it is sam. It’s not South American nor South African eyes, nor lady’s eyes nor man’s eyes. The form—eyes—will have difference, but vision will not have difference.

India's scenic drug haven

Nestling among snow-capped mountains and surrounded by apple orchards, Manali is a pleasant north-western Indian hill
town. At 6,000 feet (1,850 metres), the resort's grassy meadows, wild flowers and wooded slopes are a major draw to tourists from home and abroad. But in recent years, the idyllic hill town at the north of what is known as the Kullu valley, has gained a notorious reputation as a centre of the cannabis trade. The recent death in suspicious circumstances of 25-year-old British tourist Anna Hamilton, who had a history of drug trading, has reinforced that reputation.Missing foreigners
Since 1992, 15 foreigners have gone missing in the valley in Himachal Pradesh state, according to the Indian police. The UK-based pressure group Fair Trials Abroad alleges that 50 westerners have disappeared in the region in the last decade or so. Some 35,000 foreign tourists visit the Kullu valley every year. The police say there has been in a boom in arrivals from Israel in the past three years seeking an escape from the troubles back home. Police say some foreigners are involved in cannabis smuggling, while others marry local women and stay on.
Drug seizures have also gone up. In the past two years, the police has seized 545 kilograms of cannabis and arrested 273 people, including 75 foreigners, in the valley on drug-related charges. Cannabis - known here as 'charas' - that is grown in the valley can fetch up to $22,000 per kilogram in the international market, according to the police.Choice and variety
Buyers have a variety of fancily-named cannabis strains to choose from. . . .The locally grown, extremely refined variety, Malana Cream is reported to have won prizes in an annual cannabis competition in Amsterdam. . . .
The police says most drug deals are struck in parties celebrating the full moon in Manali and other towns in the valley.
The booming drug trade is driving locals to grow newer varieties as well. . . . "
The fact was that around Holi time Kullu Valley people let themselves
out quite a bit.
"Holi is the most colourful festival of the Hindus and falls on the Full moon day in the month of Phalgun according to the Hindu Calendar which is the month of March as per the Gregorian Calendar. This Holi festival has many elements of primitive and prolific rites and reveries that have defied civilization and prudery.For a young woman to flee entrapment in a room as was said above, and to run down to the river is to put herself in danger. SCS might have known that and knowing who was down there directed her somehow to go that route. Or he might have had someone murder her and take her to the river and throw her in saying that she was drown. However she arrived there she was on the first account of the autopsy "Strangled" or murdered. Therefore: murder is first degree murder in respect of a person when the death is caused by that person while committing or attempting to commit an offence under one of the following sections: (b) section 271 (sexual assault);
During the three days of this festival, particularly the whole country, towns, cities and villages - go gay with merry makers, streets, parks and public places are crowded with people, daubed in diverse colours, looking funny and ridiculous. Children and youngsters vie with each other in being original and use fast and sticky colours. It is all a mirthful abandon for them."
The fact that SCS immediately covered up the incident shows the mens rea, the guilty mind. That fact that here is malice in the names he gives to some students shows malice aforethought. The fact that Krishna Kant was shot prior shows that travel around the valley could be very dangerous and that the woman should have been informed. And the fact that SCS is an avowed pedophile while he students covered that up as well implicates the senior shyams at the ashram.
The fact Kalyani was sexually assaulted at the front door of her home at the ashram shows that it wasn't just drug dealers who were being killed in the valley. Therefore "Swami Shyam" should have gone to jail. He didn't and to lie for his sake is reprehensible and criminal. No great trouble was taken by the local police to investigate. The doctor's opinion was allowed to change, the presumed witness to the suicide was never named. His story was not accounted for. In the end as almost 80% of his students left SCS claimed that they were all drug addicts, drug dealers and pathological liars. Dan Chernin says "just a few bad apples." Considering that not two years prior they were thought to be his group of "saints" and "sages" we can only find conspiracy between SCS, his seniors, the ashram doctors and the Kullu Valley authority. The ashram doctors did not show any reason to confine the woman to her room. Nor did they show any reason why they should give her drugs. It has occurred before that an ashram dwelling student has been given tranquilizers. The excuse was kundalini breakdown. They would say, "she must have been crazy before she came." If they were they shouldn't have been admitted to the "high energy satsang" and all SCS has accomplished is to pretend to be doctor while giving the patient a disease. They broke down for the most part because what they thought was angelic proved to be satanic. If there were legal reasons for confinement and giving tranquillizers they were not given. In fact, if the ashram needed a reason they should have submitted the diary after the death to the authorities in Kullu, because if she really were that bad it would have showed up in her diary. They didn't. Instead it was burned. If the doctor says that he had reasons it must have been a very hasty diagnosis.
As for the sexual charge as the Globe and Mail states at least five woman testified that they had had sex with him. Below he has given a satsang about the snake. The snake he says is allowed to bite by his guru. But if you know that every year in India thousands of people die from cobras, that is a much as allowing himself to murder. Such a story inculpates the satsang, blames them about it, and condones his act. Since Jitendra has said that "Swami Shyam" had admitted to a group that he had done the pedophilia, he is guilty of that act. Since Melissa was making notes about the ashram in her diary and may have happened upon that story locking her in a room and giving her tranquilizers could be construed as section 271. If he is at all acting seductively as Anne Cushman notes, she would fear for her life. Therefore whether or not there was sexual assault on her sexual harassment would be indicated. At least two of the sexual episodes with woman were technical rapes. We could easily say that "Swami Shyam"'s behavior was at least occasionally rapacious. SCS has said often when there is a kundalini opening where one feels a need to "come down" then having sex would cut the madness. That would leave the men with an attitude that when the women go nuts what they need is a "good fuck."
Two things are certain. She was at the ashram
and in the satsang room and in fact sitting up in front of the whole
group.
She died subsequently. The doctor at first said she was strangled
before
she entered the water. That kind of diagnostic in autopsy is relatively
certain. It is an easy diagnosis. There should have been a crime scene
investigation. There wasn't. Since:
222. (1) A person commits homicide when,
directly or indirectly, by any means, he causes the death of a human

and on section 279,and it was "intended
to cause the person murdered to fear for the safety of the person
murdered
or the safety of anyone known to the person murdered." Therefore it
should
have been judged murder in the first degree.
"Swami Shyam" was not indicted for murder.

The article included here is from Anne Cushman and was posted on a short-lived travels to India publishing net. The article has since disappeared but Anne Cushman work at the "Yoga Journal," found in many health food stores. I would like to point out that I first got involved in Shyam Space in 1973 and continued to 1995 when I was very hurt by strange things.

6) The official ashram stand concerning the tragic death of Melissa Baer is one of the most reprehensible stories. First Shyam ordered a cover up of any knowledge of her by all members of the ashram. She was not to be spoken of as having visited, all video and audio taped evidence of her visit was destroyed, her personal journal (diary) was burned, and it was said that she tragically drowned in the Vyaas River. As the code of silence began to breakdown and people with a conscience began to speak out, it became known that she was heavily tranquilized at the order of the ashram, constantly supervised by ashram members, locked in a room or rooms when not supervised and lastly, may have indeed not drowned but been murdered by strangulation. When these and other questions were asked of those in charge at the ashram, a complete about face took place concerning her attendance at IMI and the less than truthful official response was as follows: There was no audio taping done of her satsang interactions with Shyam. Melissa was never video taped in satsang because there were no video tapes available due to a supply shortage from the West, as only "Super VHS tapes" will do to tape the Great Man. It was also stated that satsangs are not always audio and video taped because the taping is a voluntary job and people are not always available to do it. She was never given any kind of drug by the ashram. She was "just an innocent, naive, child-like but bright young woman, who was having a hard time with all the new experiences she was being exposed to and she especially had a hard time understanding what Shyam was saying in satsang". -Marut or Maurice Desautels

Jitendra (a close member of the SCS group Shyam Space since 1971) and who was living in Kullu Valley, had come to Canada in year 2001 and had said to his ex-wife Arti, that, "her (the victim of the pedophilia's) father had been lying in bed watching TV with his young daughter while both were naked and that he was watching pornography on TV." That was supposed to be the explanation as to why SCS has treated the girl this way. Jitendra said that SCS had told a small group in the Kullu valley ashram that it was thus. But since Jitendra has said it to Arti his ex-wife it is proof that SCS has admitted that he himself did do these things and is blaming it on the father of the child who was the subject of the pedophilia. So Swami Shyam did in fact abuse the young girl at an early age and was guilty of the act. Moreover to "admit" to a group of any size that he had in fact raped the girl is to commit to murder also. To continue with SCS at this point is aiding and abetting. By telling Arti, Jitendra has attempted to compel her to conspiracy in this act. So she tells me. I police the matter. If now Jitendra turns around and pretends that it was not said, he would have to discredit Arti as well. Which would leave us with secondary considerations, as to why anyone would say that he did it if he didn't and what did he plan on saying in court if it came to that. It would appear that in order to expose SCS or charge him in court that one would have to expose the father also. But no charge was given about the father other than the one the SCS had proposed, and further, as shown below, someone else has dreamed that her father had molested her and then been told by SCS that it would "destroy even a whole nation" if she repeated what she said. Clearly SCS was disturbed by such thoughts being aired publicly. So the fact remains that the two cases are clearly separate and SCS has admitted to the rape. The second aspect of this is the ludicrous nature of the explanation of why he did it. Surely anyone on hearing that the father was charged with pedophilia, would a. attempt to verify the charge, and b. prosecute both parties. Clearly SCS believes otherwise and is saying this just to see if anyone is going to resist any further. Thus the group is inculpated, conspires and is criminal.
Gyaan (noun) of course is that kind of knowledge that probes the deepest meditation spaces. Two things have happened. First Gyaan (name) is now defended to the satsang while they remain unaware of what has actually transpired behind the scene. He has been using this power to abuse already but now that power (gyaan) is associated with a Western woman (Gyaan) in the minds of his students. He was like that with all his names (Chetanaa, Brahma, etc) which were primary elements of Indian philosophy and all of it was connotatively resting in the West in the names of persons involved in his group while associated with ideas in the East. So of speaking of Brahm we think of Bruce, speaking of Gyaan we think of Ellen, Dikpaal, Richard and so on. So now he would be dissuading his group from questioning Gyaan (the woman) or entering into the space deeply with actual perceptions of what was going on. The validity of gyaan is erased. Secondly it is gyaan versus Yukti (connoting device). So this issue being secret and immoral now is projected as a secret to be protected (Western). There was a sudden privacy issue where people were discouraged from asking about each others affairs. Then it became an issue to ask about Gyaan as well. Hence gyaan which was the expected fruit of meditation practice was no longer an issue. SCS was covering up his unconscious and his powers. But some people had begun to realize that he was not using his knowledge for spiritual choices.
Also quite a few had gyaan about his activity that was showing him to be not quite so perfect as previously thought. Many of the older students knew many stories about him that reflected badly on him, but there could often be explained that there was some greater purpose of which they were not aware. Once the now maturing meditators became aware, the legitimization vanished. So SCS promoted forgetting and started to favor the newer students or who didn't remember those scenes of the earliest days. Note that SCS had already heard that Muktananda was accused by his followers of violence and having strange sex on teenagers, and had gotten by without being hurt. So he thought that he would share the blame with his fame, and would get away with it. Note also the Muslims used to refer to the gyaanee as a devil and the fact that Indian men often used kanya for vajroli mudra or restoring themselves and their energies. See case of Chandraswami (recent political history in New Delhi) and the fact that during his stay in Tihar prison he was allowed a visit from a Kanyaa (teenage girl).
The fact was that the victim is the beautiful child of the independently wealthy couple {name omitted} and {name omitted} (Yukti). Her father {husband and father} had made his own money and was multi-millionaire while {wife and mother} was a multimillionaire by inheritance. Ellen who had conspired with SCS to rape the child was a millionaire as well. He SCS was using the situation to create a scenario in which he would manipulate the satsang to gain control over the couple and defend himself using the wealth of the woman Ellen. Essentially understanding of this is based on SCS real attitude to the Westerner as mlechchha (a term that connotes heathen or unclean - (MW def) m. a foreigner , barbarian , non-Aryan , man of an outcast race , any person who does not speak Sanskrit and does not conform to the usual Hindu institutions f.) a person who lives by agriculture or by making weapons L. a wicked or bad man , sinner L. ignorance of Sanskrit , barbarism Nyayam.) and knowing the extreme bigotry of traditional India.
To be fair Reitman had said that she didn't know why she did it, she feared that she was doped that there was something put in the water. She was treated very skeptically by the group that had left. I believe that not only was she doped but she was subjected to a long term program where various misdirections in self development and self realizations were inserted in her being by high powered meditations, various situational manipulations, verbal subliminal and open manipulations and wrong practices or sadhana and so on.

His daughters were not married even at 40 and 50 and they were always around the ashram. He allowed them to consort with Westerners and they were not longer virgins. If you can understand that the dowry system would require him to give at least a nominal amount of money for each of the three, the expense of their marriage would account for some of the motive. The other is the loss of support in the family and the intrusion of relatives. If the boys then got married it would mean the intrusion of female relations from other families and the fact that he would now have to face himself as a person in Caste Hindu society. That would be the end of his illusions about his greatness.

This woman has really suffered on account of 'Swami Shyam's undercutting her intelligence to hide his own concupiscence. The really mean thing about it is that he is aware of the fact that since he won the Yoga Shromani Award based on lies and deceptions that exposure of his pedophilia would be damaging to India as well, and his is placing the responsibility for it on this this woman for trying to uncover her own subconscious. There is a significant transfer done in this way that has damaged the woman and afflicted her. Luckily she has sorted things out with her family and she avoided the problematic perpetuity while regaining her self worth.

Someone who has been living in Kullu for the last five years now, with whom I used to coanimate satsangs for many years in Montréal, who has also worked as a "therapist" here, has been sending letters and tapes to many common friends over the last few months to parrot that SS "is not a human being but a divine being", that "even if he did something with children, it was certainly for their evolution" that "we don't have the capacity to comprehend what guru does", and other well known lamentable statements. And that person then goes on doing character assassination against {the child} and her parents, Neerja, Sat Shakti, Becky, me and others, slinging mud toward just about the whole Western Hemisphere. She went as far as saying that {the child} (Praym Shakti) was already a pathological liar when she came into Shyam Space. Now for those who don't know {the child}, she joined Shyam Space at age two... And this person is typical of her immediate environment of friends in Kullu.

Now, do we really want to indulge more into discussions with such people? Is there any point in trying to engage in an intelligent conversation with a tape recorder? Why waste time with insensitive people who cannot see, feel and think for themselves?
At this point, further discussions and other niceties would tantamount to repeating ourselves endlessly. Anyone who can and want to act concretely by filing criminal charges and exposing in details this mess to the Indian and Canadian authorities will have my support and cooperation. But as far as I am concerned I have already pulled the chain on that stinking place, which is a total disgrace for India and the whole human race.

A piece of information:
On the FR2 TV channel (France) last night, one of the big news was the sentencing to 7 years of prison of a French national who has sexually abused an 11 year old girl in Thailand in February 1994. Even if there has been no "violence", simply because of the tender age of the victim it is automatically considered as a rape. The maximal sentence in such a case (in France) is 20 years of prison, and the prosecution had asked for 10 years, considering that the perpetrator here was repentant (he refused to have witnesses in his favour coming to the bar. He said: "I did not want to drag anybody else then myself in the mud with this affair." Of course, this sexual predator has no spiritual pretensions.
The criminal charges were laid at the French National Police and they have received the collaboration of Interpol. They said that many international organizations for the protection of youth, including the UN organization UNICEF (I don't know if this is also their correct name in English), have contributed their expertise and have also substantially contributed financially to the prosecution, even providing one of their own lawyers, Monique Pelletier. She says that the judgment is opening the way and making it easier for future similar cases. Of course, the fact that the perpetrator in that case is a Westerner living in the West made the procedures much easier, since the trial could be held in France, where there is a reliable justice system.
There is also an article on this on page A9 of today's edition (Saturday, October 21, 2000) of the Montreal newspaper "La Presse".
This is not an opinion from my side that there should be or shouldn't be legal procedures intended against SS and Ellen Reitman at this point. It is just brought here as a piece of information.
Much more important than any legal stuff is how we are going to live our own lives now; all of us and not only the people most directly hit by SS's behaviour. I personally think that the focus should remain on the beauty of Life, and everything will flow easily from there.

"one woman in kullu told me a story (not in confidence but as an example of swami's wisdom) about stumbling upon him with one of the younger children visiting/living in the ashram... this young girl was putting peas inside her vagina and the woman was shocked and embarrassed for swami's sake and the girl. supposedly, swami reprimanded or made the situation a lesson for the woman about how free children are from these constructed concepts and how she was hung up on the propriety of decent places to put peas... etc. i remember wondering why this girl would do this and why swami who was alone with her didn't stop her out of respect and gentleness "that you don't to that in front of people." it seemed innocent enough but it did strike a chord in me at the time and now i just feel that even if there was no overt sexual abuse in that instance (if indeed the story i was told is true, there is no reason i can think of that would explain why this woman would make this up)... he may have been grooming this child to feel comfortable with him in a private way... that being very open with her private parts was a natural thing to do with this man."

The following story shows SCS's use of the satsang to ridicule those who opposed him about his having sex on the students. Clearly when he mentions the six year old who was teething and biting the snake he is admitting to pedophilia. At six years old one is not in the cradle or teething. The fact that the students in the satsang laugh about it shows how the whole group has become lunatic. Making holes in the snake with pencils of course tries to dissuade them from writing about it.

The Guru, the Snake and the Power of Discriminationend satsang - scsSwami-ji (relating a story his guru used to tell): In this village, all the children in the school were afraid of a black snake who lived nearby. The children complained to guru-ji, "Whenever we go to school, the snake is on the way. So we are afraid to come to your place."
So the guru said, "OK. I’ll say the mantra."
He repeated the mantra and the snake came before the snake!) [Laughter]
So he called the snake and snake stood, knowing that it was standing before a guru.
So guru-ji said, "Bhai, why do you trouble these boys?"
The snake said, "What else do you want me to do except my nature? I have a fang! Whenever I see the boys I get inspired and I raise the fang and they are afraid. Of course, when I am in fan I cannot bite them, but they are ignorant, they don't know this.
They think
"I’ll bite them so they are afraid by themselves."
So guru-ji said to it in front of the children, "Well look, I am ordering you that you are not going to bite these children. You will just not bite."
It said, "Fine."
Often thereafter the snake would be inspired to come out of its hole, and seeing the children, it wanted to play with them.Many snakes play with the children. In Canada a child who was at teething period, five or six years old—they told me the story—he was in the cradle and a snake came over there. He caught the snake and bit it because it was teething period. [Laughter] He bit the snake! What is the reasoning?
So of course the snake obeyed guru-ji whenever it came out. And the children knew now, that snake could not bite them. So they took their pencils and they started teasing him, teasing him, making so many holes in the snake with their pencils. [Laughter] Yes.
So the snake went back again to guru-ji, "Guru-ji, can you withdraw your order? Because you told me, now I am bound to obey. But these children, they are ignorant—I told you already and you already know it. You can make them wise, but I can only play with them."
So guru-ji said, "What’s your problem?"
It said, "Well, I have stopped biting and don’t do anything. And these children have come to know."
Guru-ji said, "Where did I tell you that you should not raise your fang? You can raise the fang. Whenever they come to you, raise the fang; they will run away."
So snake said, "Well look, I was acting according to my own concept. I thought that was your order that I shouldn’t bite."
Now this is the problem in the world: if guru tells you, "You be nice," then wrong people take advantage of you. Therefore guru always leads your attention to become viveki [a person with the power of discrimination]. Guru says whatever is needed at that time.
And these people have come to know.
1) At this point in time there has never been an official response to the charges of sexual, verbal, psychological and fiscal abuse which has spanned at least the past 30 year period. Apart from trying to buy off Jean Bouchart d'Orval last summer with a phone call from Swami Shyam and part of the cost for a plane ticket to Kullu, no effort has been made to deal with this matter.
2) No wrong doing of any kind has ever been even hinted at, let alone admitted. The only official comment has come in satsang where a one time statement from SS intimated that "during the receiving of massage the ORGAN was sometimes touched and got erect". And what was the poor man to do about that "cut off the hands of his loved ones"? The issues of sexual, psychological, verbal and fiscal abuse, along with illegal bank accounts and tax fraud have never been addressed in any way.
3) The people at the ashram in Kullu have frequently written to many of us stating that they believe we who live in the rest of the world and are active on this site, are only in our minds and we do not know who Guru is if we can not understand, that no matter what Shyam does he can do no wrong. Whether it is sexual manipulation, breach of trust, verbal abuse, money laundering, pedophilia, sexual molestation of a child, rape, physical abuse, drugging of the oldest son of Shyam, tax evasion, making of child pornographic videos, tranquilizing a psychologically vulnerable and troublesome visitor or covering up a homicide after the fact; all this is okay because Guru is God and knows best. Hence they believe that this entire situation is our problem, our drama, our mind movie and has nothing to do with the people at the ashram in Kullu.
4) Since the sending of the Open Letter in October people are speaking of all this in Kullu behind closed doors and at the well renowned dinner parties hosted with such frequency by all. But no one has the courage, or the capacity of strong human compassion, to stand up in a public forum such as satsang and confront Shyam with his transgressions. Apparently the most common excuse used for not doing this is that the majority of people now in Kullu wish to protect their long established life style. However, after the arrival in Kullu of the Open Letter which laid out the wrong doing of Shyam, a surprise announcement was made that a trust fund for the support of some of the intimately faithful female devotees, is to be set up. And of course it was said again Shyam would never do anything "wrong", but even if he did anything it must have been for the ultimate growth and evolution of those people.
5) There is currently no ability to reach electronically (e-mail) any person who is an official spokesperson for the ashram. Dikpal and others have closed down their mail boxes. I am not sure what the status is concerning the official phone for IMI if such a thing exists. Despite the sincerity of the many inquiries made to Kullu on the subject of sexual and other abuses, IMI and Swami Shyam have chosen to leave them all unanswered. So all one can get is whatever other friends are willing to share, the propaganda from the official Shyam Space site and a wall of silence if you try you go beyond this. " - Maurice desautels

Therefore Ellen is used to reinforce his malicious act and the presumption of SCS was that she would use her wealth to cover up her own malice and his. Then when things began to spill out about the Melissa affair SCS had tried through various people to inculpate the Reitmann's by getting the biographic material of Ramona (wife of Howard - brother of Ellen) to Emberley. Had it been printed then the Reitmann's would be associated with Emberley's revue of ShyamSpace and what could then after be said about Ellen. By getting around the story of Govinda and Coco he could cover up his own wrongs and then by association with Esme who then turned around after leaving Govinda and married a Chinese. Hence her new name Aatmagat (self - gone or past issue- which is totally not yogic to say that aatmaa or the Self is gone or is history- such a name sounds more like 'dead meat' than a name of some immortal aspect of yogic interest or inclination).

Adding to Premeditation - an argument
The Yoopa. and the fact that the British had condemned the Yoopa. The fact that SCS gave a public speech in the CN Tower in 1981 (Seattle space Needle 1962, toronto CN Tower 1976), the fact that woman were called goats, and the date 1998, being seventeen years after the CN Tower speech. According to Hindu World, the yupa was basically a malignant thing, which sin was expiated by burning a piece of the yoopa pole. The logos on the Absolute Bliss Consciousness album resembles this item.

The yoopa has intimate relation to inception of war as the release of the Ashwamedha or "decorated horse" signaled a challenge to any in the neighborhood. This was arbitrary power and not based on dhaarma.
"In aswametha yagya , a well-decorated horse will be let out with an insignia on its forehead challenging any king to capture it and face the wrath of releasing king. If any one captures the horse, he shall be strong enough to incite a war. Otherwise, the valour and invincibility of releasing king is well established and he may proceed with the ritual proper. Now that the ritual horse released during last year by King Dasharatha has come back without being captured by anyone, thus establishing the invincibility of King Dasharatha, who can commence the ritual proper."
There is of course the eating of meat in this text as is later condemned by the Buddhist king Ashoka and slowly became a taboo among the hindu. Here there is a fundamental cognitive dissonance on the subject of killing, and of the strength of those who eat meat (protein envy).. Every year at dusshera the Ramayana is read and every year many of the Hindu faith hear the good king Dashratha did this sacrifice.

Dussehra festival is held at Dhalpur Maidan (Kullu) and the idol of Raghunathji is taken there. From his (sic) temple the Goddess Hadimba blesses the ceremonial horse. The ceremony is called as 'Ghor Pooja'."

SCS is of course one of those who had heard about this "glorious" yoopa of the ancient days. See below attack on Kalpi and Jhaansi. Morally the British might say that the "decorated horse" had appeared on their properties so they attacked and destroyed the sovereinty of India on a pre-emptive basis. Thus SCS reaction appears to have ritually murdered Melissa Baer while calling her a goat. SCS had written in his Shyam Sutras that women were a separate species.
Of course the revenues of the Kshattriya or warrior class were brought through wars. Acquiring land and wealth due to the labours of others. As such the yoopa could only be a koota-yuddha or asurim types of war. Since the worst aggression was in the "space" and the ugliest part of his activity he would claim to himself that he was into dharma yuddha. So although at first he seemed friendly and peaceful he became more assertive and aggressive as time wore on, and as he accumulated more wealth and more respect (undeserved). Of course his students were sometimes aggressive and moreover the back ground in Kullu was from time to time quite hostile as well. The progression/regression in his symbols goes Koonch (Shyam), Gwalior (Gwalipa), Chandigarh (Chandi), Kullu, and culminates in crimes against Canadians and assorted other Westerners. Because of moving from place to place and the "space" or shared super conscious transformations around the significant figures of the local and because of the fragmentation of India in terms of thought and consciousness and meaning, Shyam Charan Shrivastava gets very twisted without knowing why. He believes that he is authentic but that someone is out to do him in. Of course they are as he knows that there is a civil war forming in the Punjab and a war with Pakistan (1974) on going and various kinds of revolutionaries trying to blow up the upper crust, but he would see that his traditional peers and family were about to throw him off his guru-seat. Someone out there he feels is trying to rip-off his dignity.
"The tactics of dharma-yuddha were open (prakaasha), and it was without secrecy or stratagem, although recourse to magical means and mantras (spells) was permissible. Hence it was also called mantra-yuddha, war by spells."
Well it would seem laughable to use spells in warfare, but he SCS has actually said that the Shiv Tandawa Stotram can be used to kill your enemies. Moreover the use of mantras such as amaramhum madhuramhum (see analysis in Notes) was a way to subtly undermine the students. Misspeaking, misteaching, and afflicting the students psychologically as well as manipulation through the satsangs were also mantra-yuddha type aggression.
"Among the latter was illusion (maayaa), of which only two examples need be given: 'The king is dressed up like a god or disguised as a pillar, and when the enemy comes to worship him, slays him'; 'The king visits the enemy dressed as a woman, or as a devil or evil spirit, and kills him at close quarters' (III, P. 333)."
By appearing to be a guru he could get close enough to eclipse the critique of India while appearing to teach yoga in the name of peace and love of the early 70's.
In point of fact "Swami Shyam" doesn't know really what the Hell he is. The Kayastha are a sort of fifth caste (Excerpt from Looking for Maya. (Chapter One)© by Atima Srivastava (New Delhi: Penguin Books India, 1999) which were invented according to many during the Moghul onset to become secretarial staff. Afterward there was a myth included to say that they were of the false gotra chitragupta. many say that kayastha are shareebi kebabi which means that the eat meat and drink liquors like the rajputs. for sure they are not arya, and some would put them in the shudra groups which are often fallen arya castes. Kayastha are in fact presumed to be both Brahmin and Kshatriya by some and by others as to be neither. Some say they are nearly Moslems. Koonch as a matter of fact is suspended between Orai and the like which is almost 30% Moslem and Gwalior which is more at Hindu pure bloods. Kayastha are further judged on village of origin, profession or service, titles and honours. In others words srivastava from koonch still have to prove themselves.
"Newspaper reports then said Srivastava had got the entire chamber and its furniture washed with `Ganga jal' because it was previously occupied by a judicial officer belonging to a Scheduled Caste."
"The primary duty awarded to Shree Chitraguptjee was to create LOG of the lives of all living beings, judge their lives based on good-deeds and misdoing, and decide, upon ones death, whether they will attain NIRVANA [Completion of their LIFE CYCLE & redemption from all worldly troubles] or, receive punishment for their misdoing in another life form, till they attain NIRVANA."
His identity crisis relates to his ambition as hindustaani and he has clearly taken it out on the westerners.
"God of judgment: Yama being the judge of the dead, holds a court

presides over it. He is assisted by Chitragupta, a lesser god, who
keeps
an account of the actions of men. Yama's messengers drag the souls of
the
dead before Yama's throne."
But:
For the ancient Zoroastrians, the dead body is considered to be very
polluting and therefore elaborate funerary rituals must be observed.
First
it is washed with cow’s urine and water, and dressed in old clothing.
Then
it is placed off the earth in a corner of the room with the head not
pointing
north and three circles are drawn around the body with a metal
instrument:
No one may enter, and the magic metal-drawn circles prevent the death
infection
from escaping.
‘A dog with a four-eyed appearance is brought in
to witness that the deceased is really dead’
The high point of the ritual is called sagid, ‘dog sight’. A dog, which must have a four-eyed appearance— ie spots on its forehead— is brought in three times to witness that the deceased is really dead:
“If the dog looks at the body, it is surely dead; if the dog looks away or shows no interest ... there is an investigation as to whether the person is truly dead. The four-eyed dog’s gaze is thought to ward off evil, possibly by causing confusion and alarm in nearby evil spirits who are thrown off by the dog’s appearance.”
The point here is that the Parsis of Bombay are also an ancient bunch dating from the same period as the beginnings of the Veda. The above story about the "dog sight" is part of the Parsis lore (see Vohuman.org). This story is more like history than the corresponding story of the Vedic Yama. The Parsis are quite wealthy and successful and a small group of only about 150,000 in India. The Vedic myth of Yama has clearly originated from the actually use of the "dog sight" which would be a Persian folk-way. The meaning of the stories abrogates the Vedic myth. This brings to mind that fact that Veda were likely of Persian origin and this really hurts the self-esteem of the Hindu. But since most folks of India don't read either Veda (lower classes not allowed to - upper crust wanting to move on to something better like Upanishads) or Zend Awestha (because only Parsis do that) the story of the "dog-sight" would go around from Bombay as effective memes disrupting the settlement or compaction, of the Indian consciousness. Distribution of these memes (philosophical elements in popular assumptions and common phrases - apothegms for example) is enhanced in the 20th C by increases in communications and transport. At the same time new technologies make siddhis look unimportant, as for example knowing about others can be had by reading newspapers or using the telephone, getting on the bus and going to see them. In other words pride in the age of Indian culture is shattered. It is similar to the disruptions of the fundamentalist belief system and security in "God's Word" when they hear of actual stones being pulled up by archaeologists with ancient stories (The Epic of Gilgamesh) which are certainly like the tale of Noah. Their belief is seen suddenly as only belief and not very wise at that. So business and success minded Shrivastava feeling the threat to his mythic origins gets very "bothered".
Kashyapa is the rishi of the
gotra
(section of the group which esteems this rishi - something like patron
saint of a people) of Shrivasta (not Shrivastava). The Shrivasta are
really
aaryaa kshatriya. Srivasta is a name that applies to pure blood
Kshatriya
and is something that must have been attractive to Srivastava in his
youth.
It appears that but for one syllable (va or vakar) SCS would be truly
aaryaa
and of course be accorded that much more respect. Since Shruti (the
divine
sounding board) and mantra (the arrangement of sounds which is
empowered)
then the name of the man is presumed to be formative, and hence if one
says Shrivasta and then pauses ever so slightly and adds the VA but
stress
the final A ever so little then Srivastava is insulted, or possibly
even
injured in the psyche.. VAA or Vakar with a long AA after it, is
similar
to YAA which both mean 'or'). Thus the SCS phrase "knowing when to
bring
the space" is more deeply understood. This also points to illicit
psychic
transactions that afflicted his Western students who wouldn't have
understood
his intent. The point is that it becomes easy to blame the Westerners
for forcing the
use of the English alphabet which is a threat to SCS being. That is: is
it Shree or Sri, is it vasta (more at vastu or thing) or vaastaa
(friendship),
is vastava or vaastava (substance, reality), and moreover is shree

"mister" or is it the goddess of wealth and prosperity. This ia all to
be factored into the general antagonism toward the West. Note that many
Indians feared the fact that they didn't have a common language and

English language was used throughout government it became the common
means
of communication. It was the one language that could be used everywhere
in India, and that meant that pure Hindi became the second. This fact

irritability to the karee bole (spoken correctly) Hindi users. English
use also enabled access to the tremendous resources of the Western

the caste or clan of Shrivastava does not have gotra. Thus Holi reminds
SCS of the legends hiranyakashyapa and therefore kashyapa. Since he
coveted
the position of aaryaa and wanted to fit himself into upper caste
traditional
Hindu society he would feel agitated about the dissonance of
HiranyaKashyapa
being marked as the demonic side. Hiranya means gold and therefore
money.
That brings to memory the fact that as Srivastava he was not doing as
well
as many other Srivastava (who are High Court Justice, diplomats
scholars
with university posts, or in fact tutor to the Scindia queen).
SCS said
that Maharishi was his cousin. Maharishi (self appointed) was born
Mahesh Prasad Varma. That would mean that Varma (a Kayastha
family name) of Allahabad and the Shrivastava of Koonch were related by
the marriage of a sister of either patrilineage. Most Shyams have
believed that Maharishi's family name is Shrivastava. But it is a safe
bet that SCS calls him cousin because he is Kayastha not based on the
name. All the class of Kayashta are made over as his relatives if they
are famous. In any case the Shankaracharya denounces Maharishi and I
presume if he ever met Shyam Charan Shrivastava would find him
completely false. In any case SCS never demonstrated that he knew
anything more about his cousin than the official TM literature spoke of.

There, the Devi of delusion extolled thus by Brahma, the creator, in order to awaken Vishnu for the destruction of Madhu and Kaitabha, drew herself out from His eyes, mouth, nostrils, arms, heart and breast, and appeared in the sight of Brahma of
inscrutable birth. Janardana, Lord of the universe, quitted by her, rose up from His couch on the universal ocean, and saw those two evil (asuras), Madhu and Kaitabha, of exceeding heroism and power, with eyes red in anger, endeavoring to devour Brahma. Thereupon the all-pervading Bhagavan Vishnu got up and fought with the asuras for five thousand years, using his own arms as weapons. And they, frenzied with their exceeding power, and deluded by Mahamaya, exclaimed to Vishnu, 'Ask a boon from us.'
Bhagavan(Vishnu) said:
96-98. 'If you are satisfied with me, you must both be slain by me now. What need is there of any other boon here? My choice is this much indeed.'
The Rishi said:
99-101. Those two(asuras), thus bewitched (by Mahamaya), gazing then at the entire world turned into water, told Bhagavan, the lotus eyed One, 'Slay us at the spot where the earth is not flooded with water.'
The Rishi said:
102-104. Saying 'Be it so', Bhagavan(Vishnu), the great wielder of conch, discus and mace, took them on His loins and there severed their heads with His discus. Thus she (Mahamaya) herself appeared when praised by Brahma. Now listen again the glory of this Devi. I tell you. Here ends the first chapter called 'The slaying of Madhu and Kaitabha' of Devi mahatmya in Markandeya purana, during the period of Savarni, the Manu.
'He(Mahisasura) himself has assumed the jurisdictions of Surya, Indra, Agni, Vayu, Candra, Yama and Varuna and other (devas). Thrown out from heaven by that evil-natured Mahisa, the hosts of devas wander on the earth like mortals.
47-48. Mahisasura was surrounded in that battle with thousands of crores of horses, elephants and chariots. Others (asuras) fought in the battle against the Devi with iron maces and javelins, with spears and clubs, with swords, axes and halberds. Some hurled spears and others nooses.
49-58. They began to strike her with swords in order to kill her. Showering her own weapons and arms, that Devi Chandika very easily cut into pieces all those weapons and arms. Without any strain on her face, and with gods and sages extolling her, the Isvari threw her weapons and arms at the bodies of the asuras. And the lion also which carried the Devi, shaking its mane in rage, stalked among the hosts of the asuras like a conflagration amidst the forests. The sighs which Ambika, engaged in the battle, heaved became at once her battalions by hundreds and thousands. Energized by the power of the Devi, these (battalions) fought with axes, javelins, swords, halberds, and destroyed the asuras. Of these battalions, some beat drums, some blew conches and others played on tabors in that great martial festival. Then the Devi killed hundreds of asuras with her trident, club, showers of spears, swords and the like, and threw down others who were stupefied by the noise of her bell; and binding others with her noose, she dragged them on the ground. Some were split into two by the sharp slashes of her sword, and others, smashed by the blows of her mace, lay down on the ground; and some severely hammered by club vomited forth blood."
Hence Devi inspired Vishnu to slay the demons Madhu and Kaitabha. These two are said to be born out of the dirt in the ears of Vishnu. Krishna is also called Madhusudhana (sp?) (slayer of the demon Madhu). Despite the fact that Devi is the embodiment of the struggle against evil and her characteristics are well described, the evils of Madhu and Kaitabha are not given at all. In other words the essence of the struggle is not given. Apart from telling of a massive military campaign there is little meaning to the wars that come of the struggle. Hence the presence of Devi here is rather reminiscent of mother scolding her two boys and cleaning their ears saying, "just wait until your father gets home." Madhu is male. And they want to kill Brahma the Father of creation. Indra, Agni, Vayu, Candra, Yama and Varuna and other (devas), not relevant to a non vedic.
At least part of the motif must certainly be subversion, espionage and treason. Mr. Mulroney and General Radley-Walters being the targets. Concerning the Mulroney's the two sisters Barbara and Doreen were Shyams from 1982(?), the one Doreen had to enter the Allen Memorial Psychiatric Institute in Montreal for several months upon returning from her 6 months(?) stay (1985-6) at the ashram in India. Barbara went there (94-98?). Of the Radley-Walters his two sons were involved from 1976 on and the one Gary was not above crime. I know that he had committed at least one insurance crime.Well I know if I can believe anything that Gary himself says. He was involved also in the affair of which account is below. Now SCS had gone to visit the Radley-Walter's house in 1989 during the SCS last (?) visit to Canada. SCS had been given a tank. Well that is a world war II tank that sits on their lawn in Pedawawa. This is not what I am saying is treason. Certainly not. But SCS is a very powerful mentalist. Even though the general is retired he still has privy information. If SCS sits with him for a while he might have secrets from the general even if there are only tidbits. Not only this, but I have met at least one Indian military people in Canada that know him (SCS) and think him worthy of their friendship lets say.
Frankly, I believe that SCS would like such knowledge just to get the military police off his back so he can deal with the underground in India for intellectual properties and anything else that makes money by mentalism. He needs to please the Indian military because his ashram in Kullu is so close to the border, there are a lot of westerners there some of ill-repute especially as far as the gentility of India are concerned, and there are so many video and still cameras in use. This much at least it is possible that SCS fancies himself the epitome of Bhaarati intelligence and famous shamer of the Western world and its power to deal with India. A sort of ShivSen hero. That is because as Kaayastha and Kshattriy jati as Shrivastava are to be a recording secretary in British parliament is to be a quisling to India. This is why, in part, that because Esme Hedrik is married to Mr. Wong - a chinese man - that he finally blew up. I would be interested to know if he was actually in Kullu valley and would be seen among the Shyams by the Indian intelligence service. Get the connection between the name of Esme Hedrik-Wong = Aatmagat (which she had before going to Kullu) and the death of Mellissa? Caveat emptor? how about quia timit.
Ian Stanbury or Ananta had suffered an incident concerning a snake. It seems that he had arrived back from satsang one evening and upon opening the door to his room he found a cobra inside. He went out and got a stick and waved it around until the cobra went back out the drain pipe in his kitchen. It seems that the drain pipe was sufficient for the snake to get in. I wondered why the design of these houses was so bad that anything at all could get in. There was all kinds of dangerous things in the rooms, including spiders, scorpions, centipedes and now snakes. Cobras are really dangerous and many people die from them every year in India.
Case: Hume Wright, cabinet minister, Ottawa suicide in 1982 or 83.
"But some families also started to grow worried about relatives there and alerted Indian officials in the hope of getting them to leave.
Hume Wright, a prominent diplomat in the 1960s, visited the ashram to try to persuade his daughter, Sheila, to come home. The woman was raising her young daughter at the ashram, where like other children there she was home-taught by various devotees.
According to Mr. Wright's son, Blake, who lives in Nova Scotia, the diplomat liked Swami Shyam, but at one point shouted at him for keeping his daughter and and granddaughter in Kullu, and then returned to Canada alone. The elderly man who was terminally ill, eventually committed suicide outside Ottawa.
"Obviously, his [Swami Shyam's] power to attract people and keep them was far beyond anything we could have imagined," said Blake Wright, who filed a complaint with the Indian High Commission in London but received no reply." Stackhouse 2001, from me 2000 letters to Globe And Mail.
There is reason to believe that examination of the history of this former Cabinet minister that he was somehow provoked into suicide by a combined mind of the Shyams he knew. Both his son Gibbie and his daughter Sheila were disciples and his wife had already been to Shyam's India Ashram more than once. So had he. His son Gibbie told me (1983) that Gary Radley-Walters, a Shyam, had bought the gun that Hume had killed himself with. There was another Guru Student Harold Breck (Shankar) had during and after the death of Hume taken up a relationship with Sheila and that he had benefit of the money. Hume's inheritance had amounted to about $1,000,000 and had been divided $600,000 for Connie, $300,000 for Sheila, and none for Gibbie according to Dad's will. Gibbie left Shyam Space and to my knowledge does not know them still. The fact was that Shyam himself benefited from the inheritance from Hume of $300,000, which Hume's daughter Sheila, (Archana) had taken back to India, with her. He has probably received as much as $50,000 from Sheila.
Hal Breck was the brother of a patricide. He came from the US and he was running the Ashram in Ottawa at the time of Hume's suicide, and that both he and Shyam were proven mentalists. Shyam could read a road map in your memoirs at forty paces. At the time of the death, Connie the wife of Hume, his daughter Sheila, and occasionally Hume were visiting the Shyam Space Ashram that Hal Breck was running in Ottawa. It was during and after this time of the death of Hume that Breck took up a relationship with Sheila and was also advanced some money by her. She is now resident in Kullu valley with Shyam along with Breck, Gary Radley Walters, and Greg Radley-Walters sons of General Radley-Walters.
At this time the members in residence at the Ashram were Richard Taylor (Dikpal Skand or "Generalissimo"), Hal Breck, Leela Desautels, Anne Breck (wife of Harold), Nina Davis (wife of Michael Davis). Richard Taylor and a student Jean Jansoo-Boudreau had been members of the Privy Council. Jean Jansoo-Boudreau who was a "mole" for Joe Clark's government and a "mole" for Shyam Space, was told me about intimate associates so depraved as to crawl around under the bushes behind the Chateau Laurier for sexual liaison's with his homosexual prostitutes. In this case the information and dispositions seemed to concern what it the government doing about meditators and who would come over for satsang. Seems naive enough. But other bits and pieces about history and activities of individuals were also traded. Even before he left the Oblate Fathers he used to go out and get drunk and commit homosexual acts while still in his frock. From 1976 to 1982 or so he was in Shyam Space. Joe Clark, among other high government officials, used to dine at Jansoo-Boudreau's. So did Connie Wright and in fact Hume Wright. Richard Taylor used to go over there also. Jean even got a spiritual name from Swami Shyam. Nina Lerhman (sp?) (Mrs. Michael Davis) of Shyam Space work with Jean on the lotteries as well as giving him back massages. Jean's "leaks" to Ottawa Shyams came in drips and drabs just to give them a taste and keep them suitably impressed. Shankar (Hal Breck) and Jean were close enough for Shankar to give him back massages. This is about Patrick O"Niell who had been sent to Ottawa area ashrams (1979) and was constantly in conflict with Shankar Breck. He ultimately came to despise him. I am not sure when he left the Ottawa area but he went back to Montreal at least by 1990.
Note that Patrick has been raped by his elder step brother and was frequently at the 108 First Avenue ashram. Shankar and Dikpal have a big interest in Jean Jansoo-Beaudreau for his political connections and his financial skills. Jean is homosexual living with a wife to cover (Tiu). So Patrick would be meeting Jansoo-Beaudreau at the ashrams, while possibly neither new the others story. I met Hume myself at Jansoo-Beaudreau on a luncheon occasion hosted for the ashram.
I know that at least three women associates of this Shankar have gone insane at some point and yet gone back for more in Kullu. That is, his wife Anne Breck, Denise B., and Rita Zelicovitz (Ritambhar). Denise B. poor woman suffered from psychoses for years after coming back from Kullu valley. Her companion Keval Krishna suffered also after returning from Kullu valley. There was another woman from New England who was associated with the Ottawa crowd, went to India and came back from there, went home to America and had to start taking Lithium. They say that Sheila Wright is not well now. Sheila used to share her mail with Shankar. I believe that so much confidential information was available to Shankar (former member of the West Coast brotherhood of grass and acid dealers) "Space leader" of Ottawa Shyam Space that there must have been malfeasance involved in Mr. Hume Wright's early death. There was an inheritance of $1,000,000 and Gibbie much envied by Shankar for his brains did not get any. Leela Desautels, Richard Taylor, Sheila Wright, Harold and Anne Breck, are all resident in Kullu valley Ashram of Shyam now.
To add insult to injury Sheila went on a two week field trip with Shyam and ten or 11 others (twelve total) that cost them all $10,000 each. That is a total of $120,000, for two weeks. The persons that went on this short Himalayan tour were told that they would be enlightened if they went.
Have you ever seen the movie China Town? Well Shyam looks like the Grandpa who comes out and takes his granddaughter off to be his sexual slave (see pedophilia charges in Section 5) (also Govinda deflowered Karuna at 15?). That is how I see Shyam receiving Sheila Wright back to his Ashram in Kullu Valley.
The suicide of Hume Wright (a cabinet minister) and the use of the inheritance afterwards is criminal. Swami Shyam had used mentalistic techniques to undermine him and there was a bad scene connecting him with Jean Jansoo-Beaudreau, Connie Wright, Harold Breck, Gary Radley Walters Gibbie and Sheila Wright. The suicide occurred after he had been to Kullu valley and after Harold Breck had started to go out with Sheila Wright. Breck's father had been killed by Breck's brother and Breck had use of the $300,000 that she inherited. His wife Anne Breck had a 'nervous breakdown' during this period but nothing was said of it. Gibbie Wright had said that Gary Radley-Walters had bought him the rifle and taken it to his house. Swami Shyam and students benefited to as much as $100,000 and he had accepted a $10,000 payment from Sheila for a two week enlightenment course after the fact.

ChI, S08, V6: Then Shilaka, son of Shaalaavata said to Chikitaana of the Dalbha clan: 'Verily, indeed your Saaman, of you of the Dalbha clan, is unestablished. If now, someone were to say, your head will fall off, surely your head would fall off.'
Comment: The punishment for misleading or misteaching could be severe. The Saaman refers to the Veda and its inner purpose. Misuse of psychic power was also punished. Dubois (HINDU MANNERS, CUSTOMS & CEREMONIES, Abbe J.A. Dubios, Third edition published in 1906, ed. Henry K. Beauchamp, Reprinted by: The Oxford University Pres, Delhi, India in 1983) mentions that when a miscreant was found they would break out his front teeth saying "now pronounce your mantras"
So if anyone should start to learn of his evils he wants to remove
them
from the ashram, because if they begin to expose him he loses the
protection
of his Western devotees, and then his evil against India becoming known
he is liable to be punished most severely. He believed that Westerners
could never know what the problem was or even have "the space" to
perceive
what was done. So he had trained his spook force to speak in English
phrases
that were his new mantrayuddha. In this way anyone from India who might
see something clairvoyantly would then not be able to say with
certainty
that the spook force wasn't war minded Western spooks. Then since 1994
when I had begun to decipher his astral layer atrocity he was getting
edgy,
and when Becky died and Melissa appeared he finally decided to a. threaten
any further inquiry and b. terminate her acting like it was a sacrifice
to the yoopa.
Thus: :powers, virtues and dominions" as per Christian theology is the
relevant issue in this case: human development and enlightenment
requires
that the fitting behaviors—thought, word, and deed— be apropos to
human development; to have understanding here is to participate in the
future and the well-being of the people. Revelation, if it is
revelation,
is given by god to the people of the earth; if such judgments that
follow from revelation are to have good effect they must be for the
betterment of all. To own a scripture for one's own people is to admit
that one's teaching isn't given to the folk or people but to a
privileged group who intend to lord it over the masses—the Unclean:
such as it is, India and India's Aaryaa consider their teachings to be
privately held. One cannot convert to Brahmin caste by a vow or
ceremony as one can become a Christian or a Jew, and have equal status
with all Jews or Christians. Brahmins —and by extension many others in
that category and heirarchy—consider themselves owners of
revelation, owners even of Gods. "Thought" in the case of a well
developed yogi becomes siddhis and there is no particular adjuring
toward that power to ensure the use of such capacity for the sake of
the common good. It is not particularly for the people or for the
common good. Social injustice is still huge in India and yet many have
developed powers for the sake of "improving" their own condition, and
expect to be progressing up the social ladder by ladders of incarnation—alternatively they flee the social order and join the "vratya
brotherhoods", the wanderers, the liminals and antinomials in declining
participation in the samsara—"the world." Yet greed and lust and
ambition did motivate them and him (SCS) and he is guilty.
